Kevin Costner’s estranged wife, Christine Baumgartner, claimed that the “Yellowstone” actor could not legally force him to leave his $145 million Santa Barbara home.
Baumgartner’s attorney, John Rydell, argued that Costner’s final warrant request (RFO) was “intended to kick Christine and her three children out of the home where the children lived their entire lives,” according to court documents obtained by Insider.
“While there is virtually no legal basis for Kevin’s request to evict his wife and children from their home, it is still a matter of critical importance to Christine,” Rydell added in documents filed Wednesday.
Rydell also reportedly criticized Costner’s attorney, Laura Wasser, for refusing to delay the upcoming hearing of the case, in which a judge will decide Baumgartner’s fate.
Rydell and Wasser did not immediately respond to Page Six’s request for comment.
The filing comes just a day after TMZ received documents from the court asking the 68-year-old actor to help him kick his ex-wife out of the house.
Costner said that under their long-standing agreement, the ex-model agreed to vacate her house within 30 days of filing for divorce.
Given that Baumgartner filed to dissolve their marriage on May 1, Baumgartner was supposed to move out in early June – but still resides on the property.
Costner also claimed that Baumgartner used his position as leverage to accept “various financial demands” despite giving him more than $1.2 million for premarital obligations.
According to the documents, Costner even offered to give his ex an advance of $30,000 per month for a rented house and $10,000 for moving costs “as part of his child support obligations.”

Last month, Baumgartner decided to end their 18-year marriage, citing “irreconcilable differences”.
The filings reportedly sought joint custody of their three children, Cayden, 15, Hayes, 14, and Grace, 12, but not spousal support.
Sources told Page Six at the time that Costner was “stunned” by his wife’s decision to end their marriage and still “loves” him. [Baumgartner] and he loves his children.”
While there were rumors that cheating played a role in their breakup, a longtime friend told us, “There was no problem with cheating.”
The former couple began dating in 1998 and married six years later on the actor’s 160-acre farm just outside of Colo, Aspen, which he now rents for $36,000 per night.
